Notice of Comment Period and Public Hearing

Air Pollution Control Part 70 Permits

Notice is herby given that the Chattanooga-Hamilton County Air Pollution Control Board (Board) will receive public comments upon certain proposed permits and will hold a public hearing. The hearing will be held at 5:00 p.m., Monday, March 29, 2010, in Room 1A of the Development Resource Center, located at 1250 Market Street, Chattanooga, Tennessee. The purpose of this hearing is to receive public comments concerning Part 70 Permits for the following permits and sources.

Porter Warner Industries, 4902 Central Avenue, Chattanooga Tennessee, a manufacturer of resin coated sand for the foundry industry has applied for renewal of its Part 70 major source operating permit. This renewal involves no emissions changes or changes to the Part 70 Permit.

INVISTA S à r.l., LLC, operates a synthetic fiber manufacturing plant at 4501 North Access Road, Chattanooga, Tennessee. INVISTA has applied for renewal of its Part 70 major source operating permit. A portion of INVISTA has been purchased by KORDSA, INC. The portion retained by INVISTA requires a Part 70 permit. This renewal includes the emission units that were retained and which continue to be operated by INVISTA. This permit requires reductions in emissions of approximately 1,705 tons per year (tpy) of Sulfur Dioxide, 285 tpy of Nitrogen Oxides, 127 tpy of CO and 62 tpy of particulates.

KORDSA, INC, operates a synthetic fiber manufacturing plant 4501 North Access Road, Chattanooga Tennessee. KORDSA operates emissions units that were previously operated by INVISTA.  An initial Part 70 major source is required to be issued to KORDSA, Inc because the emissions from the units that were purchased from INVISTA and are now operated as a separate entity. KORDSA has shutdown 3 spinning machines resulting in a potential particulate decrease of 7 tons per year.

Signal Mountain Cement Company operates a Portland cement manufacturing facility at 1201 Suck Creek Road in Chattanooga Tennessee. Signal Mountain Cement Company has applied for renewal of their Part 70 permit. The renewal involves no change in emissions.

EPA has agreed to treat these draft Part 70 permits as proposed Part 70 permits and to perform its 45-day review provided by law concurrently with the public notice period. Although EPA's 45-day review provided by law concurrently with the public notice period, the deadline for submitting a citizen petition to object to the EPA Administrator will be determined as if EPA's 45-day review is performed after the public comment period has ended (i.e., sequentially).

The draft permits, the applications, all relevant supporting materials, and all other materials available to the Chattanooga-Hamilton County Air Pollution Control Bureau (the Bureau) that are relevant to the permit decisions, will be available for review at the permitting authority, the Chattanooga-Hamilton County Air Pollution Control Bureau, 6125 Preservation Drive, Chattanooga, Tennessee, beginning February 19, 2010 between 8 am and 4:30 pm on weekdays or online at www.pollutionsolution.org/Public%20Notices/home.aspx.

Comments on these matters may be made at the public hearing on March 29, 2010, or during the comment period by submitting written comments to the Director, Chattanooga-Hamilton County Air Pollution Control Bureau, 6125 Preservation Drive, Chattanooga, TN 37416-3638.
